Policy: Acceptable Use Policy (AUP)

9STAR’s AUP is intended to help illustrate some of the more likely forms of Misuse so that you can avoid inadvertently breaching our Service Agreement. This AUP is incorporated by reference into our Service Agreement.

  1. Security. The security of the information you receive from 9STAR is extremely important. As a result, you will use appropriate security precautions in your use of the ProtectNetwork Service.
  2. Respect for Laws and Regulations. You will comply with all laws and regulations applicable to you and 9STAR in your use of the Service.
  3. Examples of Misuse:
    3.1. Engaging in, Fostering, or Promoting Internet Abuse. You will not use the ProtectNetwork Service to engage in, foster, or promote (1) illegal acts, (2) conduct violating another’s rights, or (3) abusive or irresponsible behavior, including but not limited to:

    • Collecting or using information without the consent of the owner of the information (such as phishing, Internet scamming, password robbery, spidering, and harvesting);
    • Using the ProtectNetwork service to distribute software that covertly gathers information about a User or covertly transmits information about a User;
    • Interfering with the service of any ProtectNetwork User with mechanisms that include but not limited to mail bombing, flooding, or deliberate attempts to overload a system and broadcast attacks;
    • Using the ProtectNetwork service to seek unauthorized access to or use of data, systems or networks without 9STAR’s express authorization, including any attempt to probe, scan or test the vulnerability of an application service provider’s system or network or to breach security or authentication measures;
    • You will not use the Service to copy, create derivative works, distribute, perform publically, display publically, or transmit digitally in any manner any text, music, software, art, image, or other work protected by copyright law unless (1) you have been expressly authorized to do so by the copyright owner, or (2) you are otherwise permitted to do so by established United States copyright law.

    3.2. Accessing or Transmitting Offensive Content. You will not use the ProtectNetwork Service to access or transmit any content or links to any content that may reasonably be believed to (1) be illegal, (2) violate another’s rights, or (3) be abusive or irresponsible, including but not limited to:

    • Child pornography;
    • Speech that is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
    • Unfair or deceptive communication under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
    • Defamatory speech or violation of a person’s privacy;
    • Creating a risk to a person’s safety or health, creating a risk to public safety or health, compromising national security, or interfering with a investigation by law enforcement;
    • Improperly exposing trade secrets or other confidential or another person’s proprietary information;
    • Assisting others in defeating technical copyright protections;
    • Infringing on another person’s copyright, trade or service mark, patent, or other property right;
    • Promoting illegal drugs, violating export control laws, relating to illegal gambling, or illegal arms trafficking; or
    • Otherwise committing conduct that is malicious or fraudulent, or may result in retaliation against 9STAR by offended viewers.

    3.3. Testing or Monitoring ProtectNetwork.

    • Monitoring. You will not collect monitoring data or traffic on ProtectNetwork’s network or systems without 9STAR’s express authorization;
    • Vulnerability Testing. You will not attempt (1) to probe, scan, test or penetrate the vulnerability of a ProtectNetwork system or network or (2) to breach ProtectNetwork’s security or authentication measures, whether by passive or intrusive techniques, without ProtectNetwork’s express written consent.
    • Network disruptions and unfriendly activity. You will not engage in any conduct that is likely to result in retaliation against the ProtectNetwork’s network, systems, website, or ProtectNetwork’s employees, officers or other agents, such as engaging in behavior that results in any server being the target of a denial of service attack (DoS).
  4. Consequences of Violation of AUP.
    4.1. You remain responsible for any use of the Service that violates this AUP, including violations that occur due to unauthorized use of your ProtectNetwork Identity (but not including unauthorized use that results from ProtectNetwork’ s failure to perform its obligations under the Service Agreement).
    4.2. Due to the sensitive nature of the private information of the Users and their Sponsors, plus the importance of the proper use of this information to the Application Service providers, a breach of this policy will be a material breach and 9STAR may enforce any or all remedies reserved in the Service Agreement.
    4.3. 9STAR may without notice to you, suspended your service, your ProtectNetwork Identity, or the authentication of your ProtectNetwork Identity if 9STAR discovers facts that may be reasonably construed that the Service or your ProtectNetwork Identity is being used in violation of this AUP. While 9STAR will attempt to contact you prior to suspension of your ProtectNetwork privileges, prior notification is not assured.
  5. Amendments to AUP. The Internet and the ways that it may be abused are continuously evolving. Therefore, 9STAR reserves the right to amend the AUP at anytime without further notice to you. Any changes to the AUP will be communicated through our Website as soon as practical. Conduct committed prior to the changes will be judged according to the previous AUP.
  6. Disclaimer. 9STAR is under no duty, and does not undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any Misuse of the Services. 9STAR disclaims any obligation to any person who has not entered into an agreement with 9STAR for its Services.
  7. Conflict. In the event that the AUP and the Service Agreement conflict, the Service Agreement governs the parties’ agreement.
